Valuing Your Claim
Your claim will be split into two categories and if successful, you will receive an award for the pain, suffering and loss of amenity you have suffered from. You may also be entitled to a separate award for your out of pocket expenses incurred as a result of the accident.
In respect of your claim for pain, suffering and loss of amenity, your claim will be valued on the injuries suffered. Injuries are not limited but can include:
- Fractures
- Soft tissue injuries
- Whiplash
- Head injuries
- Loss of senses
- Medical or dentistry injuries
- Mental/psychological trauma
- Catastrophic, multiple injuries and death
The extent of your injuries is gathered from specialist medical experts who will be able to provide an independent medical report. It is the medical evidence that is used to quantify the value of your injury claim. It is very difficult to value your claim without any medical evidence as we are unable to establish how long you are likely to suffer for (your prognosis period), whether your condition is likely to deteriorate in the future or, whether the injury has accelerated any pre existing condition. Early assessment of the value of your claim can often be misrepresentative and dangerous.
At Personal Injury Assist Ltd we are able to provide quality, accurate advice and where possible provide explanations to help you understand the legal process.
Throughout your case you may also incur out of pocket expenses, for example, loss of earnings, uninsured losses arising out of a road traffic accident. If eligible we can recover the following items:
- Loss of earnings
- Travel expenses
- Medication costs
- Aids and equipment
- Rehabilitation, for example physiotherapy, chiropractic fees
- Policy excess
- Hire
- Assistance provided by friends and family during the recovery period
